Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Busdex (“Busdex”, “we”, “us”, “our”) and govern your use of the website and app at busdex.io. Busdex is a small, independently-run web app that lets you log and track the buses you ride, earn XP, complete sets and compete with friends. Please read these Terms carefully: by using Busdex you agree to them.

How we handle your personal data is explained in our Privacy Policy, which forms part of these Terms.

1. Eligibility

You must be at least 13 years old to use Busdex. By using Busdex you confirm that you are 13 or older and that you are able to enter into these Terms. If you use Busdex, you do so in compliance with all laws that apply to you.

2. Your account

• You can create an account with an email address and password, or by signing in with Google.
• You agree to provide accurate information and to keep your login details secure. You are responsible for activity that happens under your account.
• Choose a username that you have the right to use. Usernames, like other content, are subject to moderation and may be changed or reset if they are inappropriate.
• Let us know promptly if you believe your account has been accessed without your permission. You can change your password at any time in Account Settings, which signs other sessions out.
• One person should not run multiple accounts to gain an unfair advantage in gameplay (e.g. fake referrals, leaderboard or duel manipulation).

3. Acceptable use

When using Busdex, you agree not to:

• Post or upload content that is illegal, hateful, harassing, threatening, sexual, violent, or otherwise harmful or inappropriate, including in usernames, comments and profile pictures.
• Harass, bully, impersonate or threaten other users.
• Submit false, automated or fraudulent bus logs, or otherwise cheat, exploit bugs, or manipulate XP, levels, sets, duels, referrals or leaderboards.
• Use bots, scrapers, or automated tools to access or interact with Busdex, or attempt to bypass rate limits, location checks or other safeguards.
• Attempt to access other users’ accounts or data, probe or breach our security, or disrupt or overload the service.
• Reverse engineer, copy or resell the service except as permitted by law.

4. Fair logging & gameplay

Busdex is built on genuine bus rides. To keep it fair:

• Logging a bus requires your device location so we can verify you are close to the live bus. Spoofing your location or faking logs is a breach of these Terms.
• Logging is subject to cooldowns and limits to prevent spam and abuse.
• XP, levels, titles, gradients, sets, duels and other gameplay elements are part of a game and have no monetary value.

5. Your content

You keep ownership of the content you create on Busdex (such as comments and profile pictures). By posting content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display and use that content for the purpose of operating and providing Busdex (for example, showing your comments on a bus page, or your avatar on your profile).

You are responsible for the content you submit and confirm that you have the right to submit it and that it does not break these Terms or the law.

6. Moderation, suspension & bans

To keep Busdex safe, usernames, comments and profile pictures may be checked using automated moderation, and content or notifications may be logged for review (see the Privacy Policy). We may remove content, restrict features, and suspend or permanently ban accounts that breach these Terms or that we reasonably consider harmful, fraudulent or abusive - in serious cases, without prior notice. 7. Purchases & virtual items

• Busdex offers optional purchases of cosmetic items (such as titles and gradients) and feature upgrades. Payments are processed by a third-party payment processor; we never see or store your full card details.
• Purchased items are digital, virtual goods for use within Busdex only. They have no cash value, cannot be exchanged for money, and are non-transferable.
• Because digital items are made available to your account immediately, where the law allows you acknowledge that your statutory right to cancel may not apply once delivery has begun. Nothing in these Terms affects any non-waivable consumer rights you have under applicable law.
• For questions, refund requests, or problems with a purchase, contact busdex@thomaskeig.com.
• If your account is terminated for breaching these Terms, you may lose access to purchased items without a refund.

8. Availability & changes

Busdex is provided on an “as is” and “as available” basis as a personal, hobby project. We may change, suspend, limit or discontinue any part of the service at any time, and we do not guarantee that it will always be available, uninterrupted or error-free. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above, and continued use of Busdex means you accept the updated Terms.

9. Intellectual property

The Busdex name, design, and software are owned by us or our licensors, except for content you and other users provide. “Pokédex” and related marks are the property of their respective owners; Busdex is a fan-inspired, independent project and is not affiliated with, endorsed by, or sponsored by Nintendo, any bus operator, or any third-party data provider. You may not use our branding without permission.

10. Disclaimers & liability

To the fullest extent permitted by law, Busdex is provided without warranties of any kind, and we are not liable for any indirect, incidental or consequential loss, or for loss of data, progress or virtual items, arising from your use of (or inability to use) the service. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law (such as liability for death or personal injury caused by negligence, or for fraud). Always ride safely and follow the rules and instructions of bus operators and staff: Busdex is for logging rides, not a reason to act unsafely.

11. Governing law

These Terms are governed by the laws of England and Wales, and disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you may also benefit from mandatory protections of the law of the country where you live.
